IN THE HIGH COURT OF KERALA AT ERNAKULAM
KAUSER EDAPPAGATH, J
RESHMA RAHNA – Appellant
Versus
THE SUPERINTEDENT, CENTRAL PRISON AND CORRECTIONAL HOME, THAVANUR – Respondent
WP(CRL.) NO. 572 OF 2026

Advocates:
For the Appellants/Petitioners: SHAIQ RASAL M.
For the Respondents: M.C. ASHI, SR. PUBLIC PROSECUTOR

Emergency leave granted to life convict for verified family marriage occasion.

Headnote:The petitioner sought emergency leave for her husband, a life convict, to attend his nephew's marriage on 13.04.2026, after an application to the prison superintendent remained unconsidered. The court considered the fixed marriage date evidenced by Ext.P4. The court directed grant of one-week emergency leave from 10.04.2026. Issues framed implicitly on expeditious consideration of emergency leave applications for family events. The court reasoned that verified family occasions warrant short-term leave for convicts. Writ petition disposed of with directions for leave.

JUDGMENT

The petitioner is the wife of the convict who is undergoing life imprisonment at Central Prison and Correctional Home, Thavanur. The marriage of the convict’s nephew is fixed on 13.04.2026. Therefore, the petitioner filed Ext.P3 application before the respondent No.1 seeking emergency leave. The grievance of the petitioner is that it has not been considered so far. Hence, she has approached this Court.

2. I have heard the learned counsel for the petitioner as well as the learned Senior Public Prosecutor.

3. Ext.P4 would show that the marriage of the convict’s nephew is fixed on 13.04.2026. Hence, I am of the view that the convict can be granted emergency leave for a period of one week. In this circumstance, respondent No.1 is directed to grant emergency leave to the convict for a period of one week from 10.04.2026.
