[ W.P(C) Nos.33076/2009, 36639/2009, 1178/2010, 4161/2010 & 22163/2010 ]

K.Vinod Chandran, J WP(C) No. 33076/2009 was filed against a notice issued to cancel the registration of the petitioner and delete the permission granted to deal in Bio-diesel. In the said writ petition there was an interim order granted on 18.11.2009 directing not to cancel the registration as proposed in Exts.P10 to P12 notices.

2. Later, when a consignment of Bio-diesel was brought to the State the same was detained by the Sales Tax Authorities alleging violation of notifications issued by the Central Government and asserting that they would transfer the consignment to the authorities under the Essential Commodities Act. Therein by order dated 09.12.2009, there was a direction to release the vehicle with the goods on production of bank guarantee as directed therein. A writ appeal was filed which was closed.

3. Again, W.P(C) No. 1178/2010 was filed challenging a notice issued by the District Collector ::7::

against the consignment which was released by the interim order in the earlier writ petition.

4. W.P(C) No.4161/2010 also challenge a similar detention and show cause notice issued respectively
