The above original petition is filed under Article 227 of the Constitution of India by the respondent in O.P. No.39/2017 of the Family Court, Palakkad, seeking expeditious disposal of the O.P No.39/2017.
2. By order dated 18.10.2019. on consensus by the petitioner and the respondent,they were referred for mediation to the Mediation Centre attached to the High Court of Kerala.
3. The Mediator by report dated
8.11.2019 has reported that the petitioner and the respondent have settled all their disputes and have executed a Memorandum of agreement on 8.11.2019. The Memorandum of Agreement is signed by both the parties and counter-signed by their counsel, enumerating the terms of compromise.
4. In accordance with the terms of compromise, the petitioner and the respondent have filed I.A No.1/2019, a joint petition, under Section 13B of the Hindu Marriage Act , seeking to dissolve their marriage solemnised on 10.5.1998, by a decree of divorce on mutual consent. They have also filed independent affidavits supporting the joint petition. The parties have also filed I.A No.2/2019, seeking to waive the statutory period of six months to consider the joint petition, immediately.
