Proceedings quashed under Section 528 BNSS due to settlement between parties in matrimonial cruelty case.

ORDER

Dated this the 08^th day of April, 2026 The accused persons in C.C. No. 1134 of 2023 on the file of the Judicial First Class Magistrate Court-I, Kottayam, arising from Crime No. 798 of 2023 of Manarkad police station, filed this petition under Section 528 of the B.N.S.S. , praying for quashing all further proceedings against them. The offences alleged against the petitioners are under Sections 498A , 341, 323 r/w 34 of the IPC .

2. The prosecution case is that the 1^st accused, being the husband of the defacto complainant and the other accused being his relatives subjected her to cruelty both physically and mentally and voluntarily casued hurt to her and thereby they are alleged to have committed the aforesaid offence.

3. According to the learned counsel for the petitioners now the entire dispute between the petitioners and the defacto complainant has been settled. Therefore, he prayed for quashing all further proceedings against the petitioner.

4. The learned counsel for the 2^nd respondent/ defacto complainant also submitted that the matter has been settled and that she has no objection to quashing the proceedings against the petitioners. The petitioners have also produced Annexure A4 mediation agreement, which was produced before the Family Court, Ettumanoor. From Annexure A4 also, it can be seen that the parties have arrived at a settlement and they agreed to quash C.C. No. 1134 of 2023 pending before Judicial First Class Magistrate Court-I, Kottayam.

In the light of the above settlement arrived at between the parties, this Crl.M.C. is allowed. All further proceedings against the petitioner in C.C. No. 1134 of 2023 on the file of the Judicial First Class Magistrate Court-I, Kottayam arising from Crime No. 798 of 2023 of Manarkad police station, is quashed.
