2. Petitioner is the absolute owner in enjoyment and possession of 38 Ares of properties comprised in Thandapper No. 2618.2 in Survey Nos.91/93-5, 91/9C3-3, 91/9C 3-6 , 91/9A4, 91/9C-3, 91/9A2 and 91/10B2 of Kozhancherry Taluk of Pathanamthitta Village. Application filed by the petitioner in Form-7 was considered and allowed by the 2nd respondent vide Ext.P1 is the submission. According to the petitioner, the Form-7 application submitted by the petitioner is Ext.P17 and it is in the name of the petitioner. As per Ext.P1 order, it is stated that the application is allowed in the name of one Raju Thomas. The petitioner want to correct the same. Hence this writ petition.
3. Heard the learned counsel for the petitioner and the learned Government Pleader.
4. The Government Pleader submitted that a counter affidavit is filed stating that an enquiry is going on against the Revenue Divisional Office regarding certain discrepancies while considering these applications. I do not want to make any observation about the same. Ext.P17 is an application filed by Mohanan Nair, who is the petitioner herein. According to the petitioner, Ext.P1 is an order passed consequent to Ext.P17. But Ext.P1 is in the name of one Raju Thomas. In the reference of Ext.P1 it is stated that the application is submitted by Mohanan Nair. I think this is to be corrected. Therefore the impugned order can be set aside and there can be a direction to reconsider Ext.P17 application in the name of Mohanan Nair, who is the petitioner herein.
Therefore, this Writ Petition is disposed of in the following manner:
1. Ext.P1 is set aside.
2. The 2nd respondent is directed to reconsider and pass appropriate orders in Ext.P17 Form-7 application, in the light of the reports already received from the Village Officer and the Agricultural Officer, as expeditiously as possible, at any rate, within a period of one month from the date of receipt of a copy of this judgment.
