Writ petition dismissed as infructuous after students completed course and received certificates.

The petitioner filed this writ petition under Article 226 of the Constitution of India , seeking a writ of certiorari to quash Ext.P10 order dated 19.12.2019 issued by the 2^nd respondent, Admission Supervisory Committee for Medical Education in Kerala, whereby it was decided to keep in abeyance the approval of the students of the petitioner institution admitted for the year 2019-20 B.Pharm course; to issue a writ of mandamus commanding the 2^nd respondent to approve the admission of the students of the petitioner institution admitted to 1^st year B.Pharm Course 2019 admission; to issue a writ of mandamus commanding the 3^rd respondent Kerala University of Health Sciences to complete the registration of the students of the petitioner institution admitted to 1^st year B.Pharm Course 2019 admission and permit the students to register for the First Semester examination to be held on February, 2020, as per Ext.P13 notification dated 24.01.2020 issued by the 3^rd respondent.

2. On 07.02.2020, when this writ petition came up for admission, the learned Government Pleader entered appearance for the 1^st respondent and the learned counsel for respondents 2 and 3. In the light of the factual circumstances, this Court passed an interim order directing the 3^rd respondent to permit the students of the petitioner institution to register for the First Semester examination – February, 2020 as per Ext.P13 notification, so as to enable them to write the examination. This Court further directed that the 3^rd respondent shall keep the portal open to facilitate registration of the students.

Today, when this writ petition is taken up for consideration, the learned counsel for the petitioner as well as the learned Senior Government Pleader would submit that the students who were permitted to register for the First Semester examination – February, 2020, as per Ext.P13 notification by virtue of the interim order dated 07.02.2020 of this Court have completed the course and course certificates have already been granted to them and therefore, this writ petition became infructuous.

In view of the aforesaid submission made by the learned counsel for the petitioner as well as the learned Senior Government Pleader, this writ petition is dismissed as infructuous.
