Court permitted installment payment of loan overdues under SARFAESI to regularize account upon compliance.

Headnote:The petitioner challenged coercive recovery actions under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 ('SARFAESI Act'). Essential facts involved loan defaults leading to enforcement proceedings by the finance company. The court found mutual consent for installment repayment feasible. Primary issue was whether to permit the petitioner to settle overdue amounts in installments. The ratio decidendi emphasized balancing recovery rights with debtor opportunities for regularization, as both parties agreed to structured payments. The writ petition was allowed, directing initial payment of Rs.50,000/- by 30th April, 2026, balance in eight monthly installments from May 2026, alongside regular EMIs, with liberty to resume coercive steps on default.
