Interest claim on delayed security deposit refund to be adjudicated in civil court, not writ jurisdiction.

Headnote:Petitioner sought refund of security deposit under writ jurisdiction. Court noted refund of principal amount already made after eight years. Claim for interest directed to civil court. Issue framed on interest entitlement post-delayed refund. Court held writ inappropriate for monetary claim adjudication. Writ petition disposed, civil remedy preserved.

J U D G M E N T

Dated this the 10th day of March, 2026 Petitioner has filed this Writ Petition seeking direction to refund the security deposit made by the Petitioner. The learned Standing Counsel for the Respondent No.1 - Bharat Petroleum Corporation Limited submitted that the refund of Rs.40,000/- has already been made to the Petitioner. The learned Counsel for the Petitioner submitted that since the Respondent No.1 had been keeping the amount for nearly eight years, the interest is to be given to the Petitioner. This is a matter to be adjudicated in the Civil Court. Accordingly, leaving open the right of the Petitioner to agitate the claim for interest in the Civil Court, the Writ Petition is disposed of.
