Court directed expeditious consideration of temporary permit application under Section 87(1)(d) of Motor Vehicles Act pending regular permit renewal.

Headnote:First Paragraph: Under Section 87(1)(d) of the Motor Vehicles Act, 1988, the petitioner sought renewal of a regular permit for stage carriage KL-58/171 on the route Mundoor-Medical College-Thrissur and a temporary permit pending renewal. The regular permit renewal application remains pending before the Regional Transport Authority, with a temporary permit application filed for four months. The court directed expeditious consideration of the temporary permit application within two weeks. Second Paragraph: The sole issue was directing the authority to consider the temporary permit application under Section 87(1)(d). The court, after hearing counsel, found it appropriate to issue directions for prompt consideration in accordance with law given the circumstances. Last Paragraph: Writ petition disposed of with direction to consider Ext.P3 application within two weeks.

W.P(C)No.15027 of 2026 ------------------------------------------ Dated this the 10th day of April, 2026 JUDGMENT The petitioner has filed this writ petition for the following reliefs :

“i) To issue a writ of mandamus or any other appropriate writ, direction or order directing the 1st respondent to issue Temporary Permit in respect of stage carriage KL-58/171 on the route Mundoor-Medical College- Thrissur by considering Ext.P3 application and direct to maintain the statusquo regarding the operation of the service till orders are passed on Ext.P3 application, in the interest of justice;

ii) To issue a writ of mandamus or any other appropriate writ, direction or order directing the 1st respondent to consider Ext.P2 application submitted for the renewal of the Regular Permit expeditiously, at any rate, within a time to be fixed by this Hon’ble Court, in the interest of justice;”

2. Ext.P2 application for renewal of Ext.P1 regular permit is pending before the Regional Transport Authority. In the meantime, the petitioner has filed Ext.P3 application for temporary permit for a period of four months under Section 87(1)(d) of the Motor Vehicles Act, 1988. The limited prayer of the petitioner is for a direction to the 1st respondent to consider Ext.P3.

3. Heard the learned counsel for the petitioner and the learned Government Pleader.

4. In the facts and circumstances of the case, there will be a direction to the 1st respondent to consider Ext.P3, in accordance with law, as expeditiously as possible, at any rate, within a period of two weeks from the date of receipt of a certified copy of this judgment.

This writ petition is accordingly disposed of.
