A petitioner may withdraw a writ petition while retaining the right to file a revision as prescribed by relevant tax laws.
Headnote:

Key legal provisions from the KVAT Act were referenced, emphasizing the procedural rights and timelines for assessments and appeals.
Fact of the Case:
The petitioner sought to withdraw a writ petition with the option to file a revision under the KVAT Act, which led to the court's deliberation on procedural liberties and assessments related to prior assessment orders.
Finding of the Court:
The court concluded that the petitioner could withdraw the writ petition while granting liberty to file a revision application within two weeks, thereby preserving the right to challenge the assessment.
Issues: Whether the petitioner could withdraw the writ petition while retaining the right to file a revision under the KVAT Act.
Ratio Decidendi: The court held that a withdrawal could be permitted where a party maintains the right to file a revision application, aligning with the legal framework governing assessment procedures under the KVAT Act.
Final Decision: Writ petition dismissed as withdrawn with liberty to file revision.
JUDGMENT
Counsel for the petitioner seeks permission to withdraw the writ petition with a liberty to file O.T.(Revision).
Accordingly, the writ petition is dismissed as withdrawn with a liberty to file O.T(Revision) within a period of two weeks from today. In view of the aforementioned liberty, the interim order is extended for two weeks.
