A debtor may apply to set aside an auction sale and repay dues in installments, ensuring compliance to prevent sale confirmation.

Headnote:

Loan - Writ Petition - Article 226 - Sale Notice Quash

Fact of the Case:

The petitioner mortgaged her property for a loan and filed a writ petition to quash a sale notice issued by the Sale Officer after the property was auctioned, claiming readiness to repay the dues in installments.

Finding of the Court:

The court allowed the petitioner to apply to set aside the auction sale, provided she pays the dues in installments, with the confirmation of the sale kept in abeyance pending compliance.

Issues: Whether the petitioner could quash the sale notice and repay the dues in installments.

Ratio Decidendi: The court held that the petitioner should be permitted to repay her dues in installments, balancing her rights against the bank's interests in confirming the sale.

Final Decision: Writ petition disposed with directions for repayment in installments.
