JUDGMENT
The petitioners are challenging Exhibit P13 order of the Government, which permitted transfer of certain lands to the Panchayath for the purpose of building a shopping complex and construction of a bus-stand. The lands so transferred are comprised in Sy.No.204/1 & 204/2 of Vadayar village, part of which is in the possession of the Thalayolaparambu Boys High School, a Government school, and the adjacent lands lying as puramboke. The land in the possession of the School, being utilised for commercial purposes is decided to be transferred on payment of market value and that set apart for bus-stand on lease rent. The 1st petitioner's contention is that the 1st petitioner owns 1 Acre 68 Cents of land in Survey No.204/1 along with other co-owners, out of which he sold 10 cents to the 2nd petitioner as per Exhibit P9 deed and this is the land spoken of in Ext.P13.
2. The 1st petitioner's case arises from a deed said to have been executed in the year 1116 M.E., three pages of which are produced as Exhibit P1 & P2.
