J U D G M E N T
The writ petitioner is the complainant in the case C.C.No.294/2006, which was originally numbered as C.C.No.371/2002, on the file of the Court of the Judicial First Class Magistrate-IV, Kozhikode.
2. The allegation against the accused in the aforesaid case is that they committed an offence punishable under Section
138 of the Negotiable Instruments Act, 1881 .
3. The grievance of the petitioner, shorn of unnecessary details, is that the second accused P.Liyaquath in the aforesaid case is absconding and even though the case against him has been entered into the register of long pending cases by the trial court and numbered as L.P.No.58/2009, the second and the third respondents have not taken any effective steps to apprehend him. It is stated that the petitioner filed Ext.P2 representation before the second respondent to issue a lookout notice against the aforesaid accused but the second respondent did not take any action on that representation.
4. In the aforesaid circumstances, the petitioner has prayed for the following reliefs in this writ petition .
“a) To issue a writ of mandamus or other appropriate writ, order or direction directing the respondents 2 and 3 to take
