JUDGMENT

The prayers in this writ petition are as follows:

“(I) call for the records leading to the issuance of Ext.P5 notice by the 2nd respondent and quash the same by the issue of a writ of certiorari or other appropriate writ, or direction.”

2. Heard Sri. T.C Suresh Menon, learned counsel appearing for the petitioner and Smt. Priya Shanavas, learned Government Pleader appearing for respondents 1 & 2. In the nature of the orders proposed to be passed in this Writ Petition, notice to contesting respondent No.3 will stand dispensed with.

3. It is stated that the Taluk Land Board, Chittur had closed the Ceiling Case as against the declarant in Ceiling Case CC. No. 457/1973 as early as in 1982. The 3rd respondent, who is a near relative of the petitioner, with whom the petitioner has got civil disputes pending, has submitted a false complaint against the petitioner before the 2nd respondent Taluk Land Board seeking to re- open the closed Ceiling Proceedings. It is averred that the 2nd respondent Taluk Land Board has acted upon the said complaint by issuing impugned Ext.P5 notice dated 01/01/2019 and has directed the petitioner to appear before the said Authority for hearing.
