Matrimonial appeals disposed as settled out of court upon amicable resolution and remarriage.

Headnote:The Family Court allowed in part the wife's petition for return of money and gold ornaments (O.P. No. 614/2012), dismissed the husband's petition for restitution of conjugal rights (O.P. No. 616/2012), and dismissed the wife's divorce petition (O.P. No. 615/2012). Appeals filed by both parties challenging these judgments. Court findings noted lower court proceedings on matrimonial disputes involving restitution, divorce, and return of stridhan. Issues framed around challenges to Family Court orders on restitution, divorce, and return of property. Mat. Appeal No. 872 of 2014 has been filed by the husband challenging the common judgment dated 04.07.2014 in O.P. No. 614 of 2012 on the file of the Family Court, Muvattupuzha, by which the original petition filed by the wife for return of money and gold ornaments was allowed in part, Mat. Appeal No. 874 of 2014 has also been filed by the husband challenging the judgment dated 04.07.2014 in O.P.No.616 of 2012 filed by the husband for decree for restitution of conjugal right, which was dismissed. Mat. Appeal No. 15 of 2015 has been filed by the wife challenging the judgment dated 04.07.2014 in O.P. No. 615 of 2012 on the file of the Family Court, Muvattupuzha, whereby her original petition seeking a decree of divorce was dismissed.

2. We have heard the learned counsel appearing for the wife.

3. Today, when the case was taken up for consideration, the learned counsel for the wife submitted that the disputes between the parties have been amicably settled out of court. It is further submitted that the wife has remarried, and a petition for divorce by mutual consent had already been filed in the year 2016. An endorsement to that effect has also been made by the learned counsel for the wife.

Considering the aforesaid submission, we find that nothing survives for consideration in these matters.

Accordingly, these Matrimonial Appeals are disposed of as settled.
