The tenant in R.C.P.No.10 of 2010 on the file of the Rent Control Court, Kuthuparamba is the revision petitioner herein. The respondent herein who is the landlord of the building filed the petition for eviction on the ground of arrears of rent and bonafide need under sections 11 (2)(b) and 11(3) of the Kerala Buildings (Lease and Rent Control) Act, 1965 (hereinafter called 'the Act' for short). The allegation in the petition was that the petition schedule building originally belonged to his father Kumaran and after his death, it devolved on his wife and children including the petitioner. The petition schedule building was taken on rent by the tenant/revision petitioner herein on a monthly rent of Rs.1,200/- on 12.2.2000 as per a kychit. He had paid rent upto and inclusive of 12.8.2002 and thereafter kept the rent (Rs.1,09,200/-) in arrears. He has no job. He wanted to start an electronic shop in the petition schedule building. He bonafide requires the petition schedule building for the purpose of starting the abovesaid business. He has no other building in his possession for that purpose.
