JUDGMENT
Petitioner has approached this Court seeking the following prayers:-
“i) Issue a writ of mandamus or any other writ, order or direction to the 3rd respondent to register the sale deed transferring the property of the petitioner under Sect.P1 document without insisting No Objection from the Revenue Department.
ii) declare that the property covered under Ext.P1 document is transferable, alienable and heritable and No Objection Certificate from the Revenue is not mandatory as precondition for its registration.
iii) Issue writ of certiorari to quash Exts.P7 and P10.
iv) Issue a writ of mandamus or any other writ, order or direction in alternative to direct the respondents 1 and 2 to issue No Objection and fix fair value of the property involved in Ext.P1.”
2. Heard the learned counsel for the petitioner and the learned Government Pleader.
3. Learned counsel for the petitioner submits that the property of which the petitioner had purchased a portion had been assigned on ground rent patta to the original holders by the Maharaja of Cochin. It is stated that Ext.P3 detailed judgment is the authority on the point that though the property was assigned on ground rent patta, the property is
