ORDER

1.This application is filed under Section 438 of the Code of Criminal Procedure .

2.The petitioner herein is the sole accused in Crime No.751 of

2017 of Pattambi Police Station, registered alleging offence punishable under Section 332 of the IPC .

3.The petitioner is a Ward Member of the Ongallur Panchayat.

According to the prosecution, on 02.11.2017 at about 10.40 a.m., the petitioner entered into an altercation with the Panchayat Secretary inside the office room of the Panchayat President, in the course of which he is alleged to have unleashed a barrage of blows on the face and body of the Panchayat Secretary causing bleeding injuries. When one of the staff intervened, he is alleged to have assaulted him as well.

4.The learned counsel appearing for the petitioner submitted that the Panchayat Secretary was inimical towards him as he had complained about the corrupt practices of the Secretary and other staff members before the higher authorities. It is with a way to get back at him that a false crime was registered. It is further submitted that at the instance of the petitioner herein Crime No.752/2017 was registered at the same Police Station alleging offences punishable under
