HIGH COURT OF KERALA
K.S.RADHAKRISHNAN, P. B. Suresh Kumar, JJ
THE TATTAMANGALAM SERVICE CO-OPERATIVE BANK LTD – Appellant
Versus
KERALA STATE FARMERS DEBT RELIEF COMMISSION – Respondent
WRIT APPEAL 1064/2014

Banks must release debtor documents once payment obligations are met under the Debt Relief Commission's directives, regardless of government funding delays.

Headnote:

Debt Relief - Co-operative Banks - Debt Relief Commission Regulations - The court upheld that banks must release documents of debtors who have fulfilled their payment obligations as per the Debt Relief Commission's directions, highlighting the lawful balance between economic requirements and right to relief.

Fact of the Case:

The case involves writ appeals filed by a Service Co-operative Bank concerning the enforcement of a debt relief scheme aiding agricultural farmers, where the government would contribute 50% of the loan payments.

Finding of the Court:

The court confirmed that the co-operative bank is required to release documents of debtors once they have paid their share, regardless of the government's payment situation, thereby ensuring adherence to the Debt Relief Commission's directives.

Issues: Whether the co-operative bank can withhold debtor documents pending government payment under the Debt Relief Commission's scheme.

Ratio Decidendi: A debtor's completion of payment obligations necessitates the bank's compliance to release documents irrespective of the government's delayed payments, affirming the directive's intent of relief.

Final Decision: Writ appeals dismissed.

J U D G M E N T

Thottathil B.Radhakrishnan, J.

1.These writ appeals with applications seeking condonation of delay are filed by a Service Co-operative Bank.

2.Delay condoned.

3.The Debt Relief Commission duly constituted by the Government of Kerala came to the aid of the agricultural farmers. They were granted relief to the effect that 50% of the loan amount will be paid by the Government and 50% by the debtor farmer. The banks were directed to return the documents of the debtor on the debtor's portion being paid. The learned single Judge has rightly held that the appellant W.A.Nos.1064, 1067, 1069/14 2 Co-operative Bank cannot wait for the Government's release of its pro-rata to release the documents of the debtors. If a debtor has paid his or her component in terms of the Debt Relief Commission's directions, the bank is bound to release the documents of the debtor. It has to obviously get the remaining fund from the Government and for that purpose they cannot hold the documents of the agricultural farmer who is the debtor.

4.We are told by the learned senior Government Pleader after getting instructions from the Government that the debt relief granted through the Debt Relief Commission far exceeds the budget allotment for the previous years and therefore, the outstandings due from the Government to the Co-operative Banks and other creditors are being paid off in a phased manner. Obviously, the Government would not ignore its obligations.

5.The aforesaid is a legitimate format of working by balancing the economic requirements in terms of the Fundamental W.A.Nos.1064, 1067, 1069/14 3 Rights and Directive Principles of the State Policy.

For the aforesaid reasons, we find no ground to interfere with the impugned judgment of the learned single Judge affirming the directions issued by the Debt Relief Commission. Writ appeals are accordingly dismissed.
