Court directs expeditious consideration of interlocutory application by Waqf Board without merits opinion.

Headnote:The petitioner sought directions for expeditious consideration of a petition and interlocutory application before the Waqf Board. No specific statutes were directly analyzed in the proceedings. Essential facts involved the petitioner's request due to irregular Board sittings, with the next sitting scheduled on 23.04.2026. The court determined that while directing disposal of the main petition was not inclined, the interlocutory application warranted prompt consideration. The primary issue framed was the need for timely hearing of the interlocutory application given the Board's irregular schedule. The court's reasoning emphasized practicality, directing consideration at the upcoming sitting after hearing parties, without opining on merits. The writ petition was allowed, directing the Board to consider and dispose of Ext.P2 Interlocutory Application at its sitting on 23.04.2026.

The petitioner is before this Court seeking a direction for the expeditious consideration of Ext.P1 petition and Ext.P2 Interlocutory Application at the sitting of the Waqf Board (hereinafter referred to as ‘the Board’), which is scheduled on 23.04.2026 at Ernakulam.

2. The learned counsel appearing for the Board seeks time to get instructions.

3. Since it is stated by the learned counsel for petitioner that there is no regular sitting of the Board and the next sitting is on 23.04.2026 at Ernakulam, we are of the opinion that this matter need not be adjourned to enable the learned counsel appearing for the Board to get instructions. Though we are not inclined to direct the disposal of Ext.P1 (as Ext.P1 is the main petition), taking into consideration of the submission of the learned counsel appearing for petitioner that there is no regular sitting of the Board, we are inclined to dispose of this writ petition directing that Ext.P2 Interlocutory Application shall be considered by the Board at its sitting on 23.04.2026 and all efforts shall be taken to dispose of the said Interlocutory Application, after hearing all parties.

The writ petition will stand ordered accordingly. We make it clear that we have not expressed any opinion on the merits of the claims.
