THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON 22.04.2025, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:

JUDGMENT

Amidst the various assertions and averments made and urged in this writ petition, the petitioner seeks that the competent Authority of the first respondent – Travancore Devaswom Board, be directed to consider Exts.P6 and P7 representations, adverting to clause 11 of Ext.P5 Bye laws.

2. Sri.S.Subhash Chand - appearing for the petitioner, submitted that his client seeks that the term of Temple Advisory Committee be extended for a period of one year, so as to enable them to complete certain emergent works, which they have commenced.

3. Sri.G.Santhosh Kumar - learned standing counsel for the Travancore Devaswom Board, in response, submitted that, if the petitioner only requires the afore representations to be taken up and disposed of by the first respondent, there does not appear to be any legal impediment in doing so; however, praying that this Court may not make any affirmative declarations and leave it to the said Authority to take an apposite decision, as per law. He added that until the above decision is taken, the petitioner can continue in office.

4. In the afore circumstances, we allow this writ petition to the limited extent of directing the competent Authority of the first respondent to immediately take up Exts.P6 and P7 representations and dispose them of, after affording the petitioner an opportunity of being heard, adverting to Ext.P5 Bye laws; thus culminating in an appropriate order thereon, as expeditiously as is possible, but not later than one month from the date of receipt of a copy of this judgment.

Needless to say, as conceded by the learned standing counsel for the Travancore Devaswom Board, until such time as the afore decision is taken and communicated to the petitioner, they will be allowed to continue in office.
