IN THE HIGH COURT OF KERALA AT ERNAKULAM
HARISANKAR V. MENON, J
VIPIN RAJ – Appellant
Versus
REVENUE DIVISIONAL OFFICER, ALAPPUZHA – Respondent
WP(C) NO.1004 OF 2023

Advocates:
For the Appellants/Petitioners: R.KRISHNAKUMAR, T.JAYAKRISHNAN
For the Respondents: M.NARENDRA KUMAR, B.RAJESH, S.L. SYLAJA

Revenue authorities cannot initiate fresh proceedings to revisit settled mutation orders based on repetitive complaints once the matter is already sub judice in civil courts, absent a direct legal challenge to the initial order.

Headnote:The petitioner sought to challenge a notice issued by the revenue authority initiated upon a representation by the private respondent, attempting to revisit a long-settled mutation of property. Following the purchase of property, previous revenue authorities had already directed mutation in favor of the petitioner, noting that the private respondent's prior complaints against the predecessor-in-title had been rejected. The court held that once a final order has been passed by a competent authority, the same cannot be reopened through a fresh investigation based on recycled allegations in a fresh representation, especially when the matter has already reached the civil court forum. The core issue was whether the revenue authorities could initiate a fresh inquiry into a settled mutation status. The court determined that in the absence of a timely legal challenge to the initial order, the administrative authorities erred in initiating a roving inquiry. The ratio decidendi established that administrative finality must be respected when previous valid orders determine property interests, leaving the determination of title exclusively to the pending civil litigation. The writ petition is allowed, and the impugned notice stands set aside, preserving the right of the respondent to pursue civil remedies.

JUDGMENT

The petitioner purchased an extent of 4 Acres 84 cents of property from one Smt.Krishnakumari, in the year 2014. The petitioner sought for mutation of the afore property on the basis of the sale deed executed by the afore Krishnakumari. Originally, mutation was not effected as sought for by the petitioner, essentially on the basis of a complaint raised by the party respondent herein - the 4th respondent, who had also filed civil suit/s with respect to the very same property in question, seeking to claim the right of the property. The 4th respondent had also originally proceeded against the afore referred Krishakumari. However, once the complaint raised by the 4th respondent against Smt.Krishnakumari stood rejected, the District Collector, by the order at Ext.P1 dated 18.05.2015, considered the issue in detail and found that insofar as the petitioner purchased the property from Smt.Krishnakumari, on the basis of the valid title deed, mutation requires to be effected in the name of the petitioner, though subject to the final result of the suit filed by the 4th respondent. It requires to be noticed further that on the basis of Ext.P1, tax was also accepted from the petitioner herein, as evidenced by Ext.P2 tax receipt dated 22.08.2022. However, the 4th respondent herein has sought to institute a fresh complaint/representation as seen at Ext.P8 dated 03.03.2021, again seeking to challenge the mutation in favour of the petitioner. On the basis of Ext.P8, the Revenue Divisional Officer (RDO) has issued Ext.P9 notice dated 23.11.2022, directing the parties to appear for hearing on 15.12.2022. It is seeking to challenge Ext.P9 issued as above, that the petitioner is before this Court.

2. Heard Sri.T.Jayakrishnan, learned counsel for the petitioner, Smt.S.L.Sylaja, learned Government Pleader, as well as Sri.M.Narendra Kumar, learned counsel for the 4th respondent herein.

3. The parties were directed to maintain status quo while admitting the writ petition, on 12.01.2023.

4. It is to be noticed that the properties were directed to be mutated in favour of the petitioner pursuant to the proceedings of the District Collector at Ext.P1 dated 18.05.2015. While issuing the order at Ext.P1, the District Collector has taken into account the complaint raised by the 4th respondent against Smt.Krishnakumari as well as continued against the petitioner herein. It is only because the complaint lodged by the 4th respondent against Smt.Krishnakumari was decided against the 4th respondent, that by Ext.P1 order, the District Collector directed the mutation to be effected in favour of the petitioner. The order at Ext.P1 has also taken note of the entitlement of the 4th respondent to approach the Civil Court against the mutation and such other proceedings in favour of the petitioner herein, on the basis of the sale deed executed by Smt.Krishnakumari. It is also made clear that the mutation would be subject to such suit, if any, instituted by the 4th respondent herein. This Court also notices that suits have also been instituted by the

4th respondent, as evidenced by Ext.P4 suit (O.S. No.685 of

2015) before the Munsiff’s Court, Alappuzha.

5. In such circumstances, I am of the opinion that the further roving enquiry proposed by the RDO pursuant to Ext.P9 notice on the basis of a subsequent representation filed by the 4th respondent could not be sustained. This is especially so, since Ext.P1 is not challenged by the 4th respondent, in a manner known to law. For the very same reason, I am of the opinion that the petitioner is entitled to succeed.

Therefore, this writ petition would stand allowed, setting aside Ext.P9 notice issued by the RDO. However, it is made clear that this would be without prejudice to the right of the 4th respondent with refer
