IN THE HIGH COURT OF KERALA AT ERNAKULAM
Kauser Edappagath, J
Basoon Babu – Appellant
Versus
State of Kerala – Respondent
BAIL APPL. NO. 2419 OF 2026
For the Appellants/Petitioners: Dennise Jacob Savy
For the Respondents: Sreeja V.
The court may grant bail in serious criminal matters when the victim and relevant witnesses deny the occurrence of the alleged incident, indicating the lack of necessity for continued detention.
Headnote:The petitioner sought regular bail under S.483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, regarding allegations of aggravated sexual assault under the Bharatiya Nyaya Sanhita and the Protection of Children from Sexual Offences Act. The accused had been in judicial custody since 04.03.2026. The court addressed whether the continued detention was necessary given the victim's statement. The ratio decidendi pivoted on the interaction with the victim and her mother, who expressly denied the occurrence of the alleged incident, thereby undermining the prosecution's case. The application for bail was allowed subject to conditions, including the execution of a bond and restrictions on witness tampering and travel.

4. I have heard Sri.Dennise Jacob Savy, the learned counsel for the applicant and Smt.Sreeja V., the learned Senior Public Prosecutor. Perused the case diary.
5. The learned counsel for the applicant submitted that the applicant is innocent and has been falsely implicated in the present case. The counsel further submitted that no materials are on record to connect the applicant with the alleged crime; hence, he is entitled to bail.
