A contempt petition may be dismissed as infructuous when the underlying grievance or the necessity for compliance has been rendered redundant by the efflux of time.

Headnote:The present proceedings relate to a contempt case filed against officials of the Southern Railway. The petitioner initiated this action alleging non-compliance with the order passed in OP(CAT) No.181/2018. The core issue before the court was whether the respondents remained in contempt of the previous order. However, during the hearing, the petitioner's counsel acknowledged that the matter had become redundant. The court, noting the submission of the counsel that the passage of time rendered the matter infructuous, dismissed the contempt petition.

JUDGMENT

The learned counsel for the petitioner submitted that, by the efflux of time, this matter has become infructuous.

Therefore, no further reliefs have been sought.

In the afore circumstances, this Con.Case(C) is dismissed as having become infructuous.
