A petitioner may seek leave to withdraw a writ petition with liberty to file a fresh one at a later stage, provided circumstances warrant such action.

Headnote:The present case involves a writ petition filed under Article 226 of the Constitution seeking police intervention in a private civil dispute. The petitioners, claiming rights over a religious site, sought the court's assistance against the respondents. The core issue centered on whether the court should exercise its extraordinary jurisdiction to resolve a dispute that was already pending before civil forums. The court noted the request of the petitioner to withdraw the matter due to ongoing developments. The writ petition is dismissed as withdrawn, with liberty granted to the petitioners to file a fresh writ petition if circumstances warrant.

JUDGMENT

The learned counsel for the petitioner submitted that, though the dispute raised in this writ petition still subsists, due to various reasons, petitioners do not intend to prosecute the matter at this moment. He seeks permission to withdraw this writ petition with liberty to file a fresh writ petition as and when circumstances warrant. Reserving the aforesaid liberty, this writ petition is dismissed as withdrawn.
