IN THE HIGH COURT OF KERALA AT ERNAKULAM
P.V.Kunhikrishnan, J
Jyothi – Appellant
Versus
State Of Kerala – Respondent
WP(C) NO. 18581 OF 2026

Advocates:
For the Appellants/Petitioners: Vinayak G Menon
For the Respondents: Vidya Kuriakose

State authorities are under a legal obligation to process statutory applications under the Kerala Conservation of Paddy Land and Wetland Rules, 2008, within a reasonable, specified time frame to ensure administrative efficiency and procedural fairness to the applicant.

Headnote:The case involves a request for a writ of mandamus under the Kerala Conservation of Paddy Land and Wetland Act, 2008, seeking directions for the processing of a Form 5 application. The petitioner sought the preparation of a report by the agricultural authority and the subsequent disposal of the application by the designated revenue officer. The court, noting the request for an expedited decision, determined that the respondents should process the pending application within a specified timeframe. The central issue was whether the statutory authorities could be compelled to process an application for land status change within a defined period. The court followed established administrative law principles regarding the timely disposal of statutory applications, determining that procedural fairness necessitates a specific timeline for state authorities to resolve such requests. The writ petition was disposed of with a direction for the agricultural authority to submit a report within one month and for the revenue officer to pass final orders on the application within four months, subject to the application being in order.
