J U D G M E N T
1. This appeal has been filed by the sole accused in Crime No.327 of 2026 of Edathala Police Station, Ernakulam, challenging the order dated 11.05.2026 in Crl.M.P No.2/2026 issued by the Special Court under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (`SC/ST (POA) Act’ for short hereafter).
2. Heard the learned counsel for the appellant and the learned Public Prosecutor. Also heard the learned counsel for the 2nd respondent/defacto complainant. Gone through the prosecution records as well as the objection filed by the 2nd respondent.
3. Here the prosecution alleges commission of offences punishable under Section 69 of Bharatiya Nyaya Sanhita, 2023 (`BNS’ for short hereafter) and Sections 3(2)(va)) and 3(1)(s) of the SC/ST (POA) Act. The case of the prosecution is that the appellant/accused, who was
holding the post of Manager of a company by name `Future Fly International Pvt. Ltd.’ and who doesn’t belong either to a Scheduled Caste or Schedule
