JUDGMENT

This writ petition is filed with following prayers:

i. To issue a writ of mandamus or any other appropriate writ, order directing the 1st respondent to forthwith enforce Exhibit P5 final order dated 08.07.2025 and remove the unauthorized constructions carried out by the 3rd respondent in Building Nos. 12/91 and 12/92 of Thalayazham Grama Panchayath;.

ii. To issue a writ of mandamus or any other appropriate writ, order directing the 1st respondent to o take immediate steps to remove the unauthorized name boards installed by the 3rd respondent obstructing the petitioner’s ingress and egress;

iii. To pass such other writ order or direction that this Hon’ble Court may deem fit and proper in the facts and circumstances of the case;

iv. To award the costs of this petition to the petitioner.

v. To dispense with filing of translation of vernacular documents.

2. When this writ petition came up for consideration on 10.04.2026, this Court passed the following order:

“The Counsel appearing for the 3rd respondent submitted that the alleged illegal construction is already removed.

The 1st respondent will inspect the property and submit a report before this court as to whether the unauthorised construction is removed or not. The report shall be placed on or before 10.06.2026.

Post on 10.06.2026.”

3. Now a statement is filed stating that the entire unauthorised construction is removed. If that is the case, nothing survives in this case. If there is any fresh cause of action, the same is left open.

With the above observation, this writ petition is closed.
