IN THE HIGH COURT OF KERALA AT ERNAKULAM
M.A.Abdul Hakhim, J
Jasmin.K – Appellant
Versus
State Bank Of India – Respondent
WP(C) NO. 23369 OF 2025
For the Appellants/Petitioners: T.M.Abdul Latheef
For the Respondents: Deepa Narayanan, Preethi. P.V., Mary Liya Sabu, Aiswarya S. Ashokan, Neeraj Krishna Kumar, Aravind K., T.Sethumadhavan
A bank's right of general lien under Section 171 of the Indian Contract Act, 1872, cannot be invoked to withhold documents deposited as security for a loan that has been closed, especially when the bank's claim regarding another outstanding liability has been unsuccessfully litigated.
Headnote:The petitioner challenged the respondent bank's refusal to release title deeds deposited for a home loan, despite its closure. The bank asserted a general lien under Section 171 of the Indian Contract Act, 1872, citing an outstanding car loan liability. The court found that since the litigation regarding the car loan was dismissed and no further appeal was preferred by the bank, there was no justification to withhold the documents. The central issue was whether the bank could exercise a lien over title deeds for an unrelated, unsuccessfully litigated debt after the primary secured loan was repaid. The court reasoned that in the absence of an active debt recoverable to support the lien, the documents must be returned to the title holder. The writ petition was disposed of with a direction to the respondent bank to deliver the title deeds to the petitioner within one month.

THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON 09.06.2026, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:
JUDGMENT
Dated this the 09th day of June, 2026
1. Petitioner has filed the Writ Petition seeking direction to the Respondent Bank to release the title deed deposited by the Petitioner to secure a home loan.
2. The learned Standing Counsel for the Respondent Bank submitted that even after closure of the home loan, the documents were retained by the Bank exercising the Bank's general lien under Section 171 of the Indian Contract Act, 1872, since the liability under a car loan was outstanding. Though the Bank filed the suit with respect to the car loan, the suit was dismissed and appeal was also dismissed and the Bank has not filed a second appeal. Hence, the Bank can return the title deeds within one month.
3. Accordingly, this Writ Petition is disposed of directing the Respondent Bank to deliver the title deed/Sale Deed No.1107/2011 dated 25.04.2011 of SRO, Kottayam, to the Petitioner within a period of one month from the date of receipt of a copy of this judgment.
