HIGH COURT OF KERALA
R.BASANT, M.C.HARI RANI, JJ
GOPALAKRISHNAN – Appellant
Versus
KITTAN VADUTHALAYIL HOUSE – Respondent
WRIT PETITION (CRIMINAL) 191/2009
An adult's legal marriage ensures autonomy and protection against claims of illegal detention by relatives.
Headnote:
Habeas Corpus - Custody of Major - Constitution of India - Article 226 - The court upheld the legality of an adult's choice to marry and live with her spouse, establishing that a valid marriage precludes claims of illegal custody.
Fact of the Case:
The petitioner sought a writ of habeas corpus for his daughter, who had been missing but was later found. She confirmed her legal marriage to a man and expressed no desire to return home, leading to the dismissal of the petition.
Finding of the Court:
The court found that the daughter, being a legal adult, had married and was not under illegal confinement. The court accepted her statements and the marriage documents presented, establishing her autonomy.
Issues: Whether the daughter was being unlawfully detained and if the writ of habeas corpus was applicable in her case as an adult.
Ratio Decidendi: The court determined that as the daughter was of legal age, her marriage was valid, and no illegal custody was present.
Final Decision: The writ petition was dismissed, allowing the daughter to leave with her husband.
