2011 Supreme(Online)(KER) 43502

HIGH COURT OF KERALA
T.R.RAMACHANDRAN NAIR, J
GEENA PARVEEN – Appellant
Versus
THE PRINCIPAL, FAROOK HIGHER SECONDARY – Respondent
WRIT PETITION (CIVIL) 20664/2011

A student must register and attend classes to be eligible for examination results and further academic progression.

Headnote:

Examination - Writ Petition - None

Fact of the Case:

The petitioner sought a direction for the production of examination results and permission to sit for subsequent examinations, claiming she had passed her Plus 1 exam.

Finding of the Court:

The court found that the petitioner had not registered for the examinations and was not attending classes, leading to the dismissal of her petition.

Issues: Whether the petitioner is entitled to receive results and permission to take future examinations despite failing to register.

Ratio Decidendi: The ruling emphasized that the petitioner’s failure to register and attend classes negated her claim, leading to the conclusion that no orders were warranted.

Final Decision: Writ petition dismissed.

J U D G M E N T

In this writ petition, the petitioner seeks for a direction to the first respondent to produce the marklist of Plus 1 examination of the petitioner to declare that she has passed and to produce the same before the second respondent and direct the respondents to give permission to the petitioner to write the second year examination.

2. Even though notice was served on the first respondent there is no appearance. The second respondent has filed a counter affidavit. It is averred in para.6 and 7 of the counter affidavit as follows:-

“6. After 2008-09, the petitioner has to register for the examinations conducted by the Department. The petitioner was orally requested by the class teacher to register for the examination which she did not do. Met with the above contingency, I informed my W.P.(C). No.20664/2011 counsel that the petitioner has neither registered herself nor remitted the fee for Higher Secondary examinations, the last date of which was fixed as 02/09/2011. I am informed by the counsel that a Memo to that effect was filed before this Hon'ble Court on 31/08/2011 which is recorded by this Hon'ble Court.

7. The petitioner is not attending the classes after 22/08/2011. She has also not remitted the fee and registered for the examinations.”

3. It is thus clear from the averments of the petitioner that the petitioner is no longer pursuing her studies. Therefore, no orders are called for in the writ petition and the same is, accordingly, dismissed.
