O R D E R

This criminal original petition has been filed seeking to quash the proceedings pending in C.C.No.98 of 2017 on the file of the Judicial Magistrate Court, Thiruthuraipoondi, Tiruvarur.

2.The case of the prosecution is that on 30.05.2015, the members belonging to a particular Association formed into an un- lawful assembly and raised slogans against the Police and also attempted to assault the Police. Based on the same, an F.I.R. came to be registered in Crime No.228 of 2015. On completion of investigation, final report was filed before Judicial Magistrate Court, Thiruthuraipoondi, Tiruvarur and the same was taken on file in C.C.No.169 of 2015. There were totally 33 accused persons in this case. Since some of the accused persons were not appearing in Court, the case was split up and trial proceeded with in C.C.No.169 of 2015 against A1 to A9, A13 to A16, A18 to A20, A22, A23 and A30. The Trial Court on considering the facts and circumstances of the case and on appreciation of evidence, came to the following conclusion:
