O R D E R
This writ petition has been filed for a direction to the respondents to pay salary / stipend of the petitioners on par with the emoluments paid to the resident junior Doctors.
2. The case of the petitioners is that the petitioners 1 to
4 were admitted in the year 2018 to undergo post Diploma DNB (Secondary DNB) two years course in Southern Railways Head Quarters Hospital, Perambur and petitioners 5 to 11 have been admitted in the year July 2018 to undergo post MBBS DNB (Primary DNB) three years course in Southern Railways Head Quarters Hospital, Perambur.
2. According to the petitioners, the stipend payable to the DNB students is being fixed by the 2nd respondent periodically. DNB trainees are required to serve as resident Doctors in the hospitals, where they are undergoing the course. The further case of the petitioners is that the Government of India by proceedings dated 06.04.2009, ordered that the stipend / emoluments payable to the DNB trainees, shall be in accordance with the salary payable to resident Doctors.
3. In the year 2014, the 2nd respondent re-fixed the minimum stipend payable to the DNB trainees. According to the petitioners, the same was fixed with a reduced
