O R D E R

This Writ Petition has been filed seeking a direction to the respondents herein to sanction and disburse all monetary benefits payable to the petitioner under the Contributory Pension Scheme with appropriate interest.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the materials available on record.

3. The case of the petitioner is that he was initially appointed as Watchman in the weekly market run by the Manachanallur Panchayat Union. Later, he was transferred to the third respondent Town Panchayat. His service was regularized from 01.01.2006 onwards as Sanitary Worker and he retired from service on 29.02.2024. After retirement, the petitioner submitted various representations and finally, submitted a representation on 03.09.2024 seeking to sanction and disburse the monetary benefits arising out of Contributory Pension Scheme. As there is no response, the petitioner is constrained to file this writ petition. 4. The learned counsel for the petitioner submits that as the monetary benefits arising of the Contributory Pension Scheme are not yet paid till date, it is causing huge financial constraints to lead day to day life of the petitioner.

On the other hand, the learned Government Advocate, on instructions, would submit that the Contributory Pension Scheme proposal of the petitioner is forwarded to the first respondent on 14.03.2025 by the third respondent. Now the third respondent has to sanction and to issue authorization letter for payment payable at the Sub Treasury, Manachanallur. The learned Government Advocate also placed the relevant documents before this Court for perusal along with proposal letter dated 14.03.2025. All those documents are placed on record.

Though the petitioner retired on 29.02.2024, monetary benefits are not settled yet by the respondents and now, during the pendency of this writ petition, the third respondent sent proposal on 14.03.2025 to the first respondent and the first respondent has to pass sanction order and the Sub Treasury Officer, Manachanallur, has to take further action to disburse the terminal benefits.

Taking into consideration all the facts and circumstances of the case, this Court intends to dispose of the writ petition with consent of both sides with a direction to the first respondent to pass orders on the recommendations made by the third respondent on 14.03.2025 within a time to be stipulated herein to meet the ends of justice.

Accordingly, the first respondent is directed to pass orders on the proposal sent by the third respondent in R.C.No.204/2024/A1 dated 14.03.2025 to settle the terminal benefits to the petitioner within a period of two weeks from the date of receipt of a copy of this order. The respondents are directed to take steps to disburse the terminal benefits to the petitioner within a period of two weeks thereafter.

There shall be no order as to costs.
