O R D E R

This civil revision petition is directed against the order dated 22.03.2024 passed by the learned trial Judge allowing I.A. filed by the defendants 5 to 8 for reception of their counter claim.

2.O.S.No.69 of 2018 was filed for declaration that the memorandum of family arrangement dated 26.04.2018 entered among the parties to the suit recording the oral family arrangement is legally valid and binding. This suit prayer is contested by the revision petitioners herein who are figuring as defendants 1 to 4. The defendants 5 to 8 have filed written statement. They are also on the same page as that of the plaintiffs. In their written statement, it has been specifically prayed that the suit may be decreed as prayed for.

3.The defendants 5 to 8 are seriously apprehensive that the plaintiffs may join hands with the defendants 1 to 4 and that may compromise their interests. They have therefore filed I.A. No.10 of 2023 for acceptance of their counter claim which is to the effect that the suit memorandum of family arrangement is binding on the parties. They have also made a consequential prayer for granting permanent injunction against the plaintiffs and the defendants 1 to 4 in respect
