HIGH COURT OF MADRAS
Honourable Mr Justice P.D.AUDIKESAVALU
Z.Mohamed Tahir Sahib – Appellant
Versus
The Union of India – Respondent

Disputes concerning Waqf properties must be resolved in the appropriate Tribunal prior to judicial intervention.

Headnote:

Waqf - Demolition of Mosque - None

Fact of the Case:

The petitioner sought to declare the proposed demolition of an ancient mosque as illegal and unconstitutional, arising from conflicting demands for its preservation or demolition, prompting a referral to the Waqf Tribunal for resolution.

Finding of the Court:

The court advised the petitioner to approach the Waqf Tribunal for redress and directed the Tribunal to conduct hearings on disputes concerning the mosque, ensuring proper procedure and justice are upheld.

Issues: Whether the petitioner can seek intervention to prevent demolition of a mosque without first availing remedies through the Waqf Tribunal.

Ratio Decidendi: The court reinforced the necessity of resolving disputes related to Waqf properties at the appropriate Tribunal before involving higher courts, reflecting on proper legal channels for heritage conservation.

Final Decision: Writ Petition disposed with direction to approach the Waqf Tribunal.
