With the consent of both the parties, these Civil Revision Petitions are taken up for final hearing at the stage of admission itself.
2. These revisions have been filed against the order allowing the applications filed by the respondent/first defendant to reopen the case and recall DW1 and to mark the deposition of one Gopalsamy, who was examined as DW2 in an earlier round of litigation between the parties in O.S.No.73 of 1997.
3. The brief facts leading to file the Civil Revision Petitions are as follows :
Earlier, the respondent herein filed a suit in O.S.No.73 of 1997 on the file of the Sub-Court, Cuddalore for declaration and permanent injunction against the petitioners herein. In the above suit, the petitioners herein had claimed right over the suit schedule property based on the Will, said to have been executed by one Munusamy Nadar and in order to prove the genuineness of the Will, the petitioners herein examined one Gopalsami as DW2, who is the attestor of the Will. The said suit has been dismissed by the trial court upholding the validity of the Will and the appeal filed by the respondent in A.S.No.17 of 2003 on the file of the Additional District Judge,
