ORDER

This writ petition has been filed challenging the order dated

05.03.2022 passed by the respondent under Section 15 of the Foreign Trade (Development & regulation) Act, 1992 read with Foreign Trade (Development & Regulation) Amendment Act, 2010 (Notification dated 20.08.2010), calling upon the petitioner to pay a fiscal penalty of Rs.1,50,000/- in addition to the notional customs duty and interest thereon under Section 11(2) of Foreign Trade (Development & Regulation) Act, 1992 read with Foreign Trade (Development & Regulation) Amendment Act, 2010 (Notification dated 20.08.2010) for non-fulfilment of export obligation.

2. Heard Ms.V. Pramila, learned counsel for the petitioner and Mr.C. Samivel, learned Senior Central Government Standing counsel for the respondent.

3. The petitioner has challenged the impugned order on the ground of violation of the principles of natural justice. According to the petitioner, the impugned order is an ex-parte order and despite request made by the petitioner for grant of adjournment on 14.10.2021 for production of certain documents in support of the case, the respondent has passed the impugned order without hearing the petitioner.
