JUDGMENT

The unsuccessful plaintiff before the Courts below is the appellant before this Court and the parties are referred to in the same litigative status as before the Trial Court. The facts in brief are as follow:-

2.The plaintiff had filed a suit O.S.No.30 of 2012 on the file of the Additional District Munsif, Myladuthurai seeking grant of an injunction restraining defendants 1 and 2 from in any manner trespassing and removing the trees, fences, ridges in the suit property belonging to the rd plaintiff and for a direction to the 3 defendant to rectify the survey number which was wrongly entered as Survey No.344/3 in the sale deed dated

19.04.1982 instead of Survey No.343/2A.

It is the case of the plaintiff that he had purchased the suit schedule properties from the 3rd defendant under a Registered Sale deed dated 19.04.1982 and has been in possession and enjoyment of the same since rd then. The 3 defendant had in turn purchased the property under a sale deed dated 16.12.1980 from one Smt.Thailammal.
