O R D E R

This Writ Petition has been filed, to call for the entire records pertaining to the impugned proceedings in Ka.No.15/S1PS/ALR/2022 dated 29.08.2022 passed by the 2nd respondent, quash the same and consequently direct the 1st respondent to grant permission to perform the Sacrificer's Memorial Tribute at Playground at Parukkal Village, Udayarpalayam Taluk, Ariyalur District on 25.09.2022, Sunday morning

10 a.m., to 5 p.m.,.

2.The learned counsel for the petitioner would submit that the petitioner's father is the Coordinator of Senthamizhagam Padippu Vattam with a motto to create awareness of Class liberation and democracy among the society. Therefore, the petitioner's father along with members of the organisation decided to conduct Sacrificer's Memorial Tribute on 01.09.2022 and they seek permission from the 2nd respondent-the Inspector of Police, Udayarpalayam Police Station, by their representation dated 20.08.2022. The said representation was rejected by the 2nd respondent on 29.08.2022, stating that it will affect law and order situation. Since they are proposed to conduct only a meeting, no agitation will be caused to the general public and prayed to set aside the order dated 29.08.2022 in Ka.No.15/S1PS/ALR/2022. Now, the petitioner prayed to direct the 1st respondent to grant permission, to perform the Sacrificer's Memorial Tribute on 25.09.2022 and the date also lapsed, prayed to permit them to conduct the said Tribute on any of the forth coming Sunday.

3.When the matter was taken up for hearing, the learned Government Advocate appearing for the respondents would submit that if the petitioner gives fresh representation, the 2nd respondent is ready and willing to consider the same.

4.In view of the submission made by the learned Government Advocate, the petitioner is directed to submit a fresh representation to the 2nd respondent, mentioning the date, on which day they intend to conduct the Sacrificer's Memorial Tribute. On such receipt of the representation, to conduct the Sacrificer's Memorial Tribute at Playground at Parukkal Village, Udayarpalayam Taluk, Ariyalur District, the 2nd respondent is directed to consider the same on merits and grant permission and also provide sufficient police protection.

5.With the above direction, Writ Petition stands disposed of. No costs.
