O R D E R

This civil revision petition seeks to strike off O.S.No.5858 of 2024 on the file of the VII Assistant City Civil Court at Chennai. The revision is at the instance of the defendants 1 & 2.

2.For the sake of convenience, the parties will be referred as per their rank in the suit.

3.The first defendant married the plaintiff on 02.06.2014. A female child was born to the couple on 18.03.2015. The second defendant was born on 02.05.2021. The parties separated on 24.05.2022.

4.Alleging cruelty and desertion, the plaintiff presented H.M.O.P.No.148 of 2023 on the file of the Family Court at Perambalur. Pleading that she is unable to travel from Chennai to Perambalur, which affects her work as a Nurse, a transfer petition was moved before this Court by the 1st defendant. The transfer petition was ordered and H.M.O.P.No.148 of 2023 was transferred to the file of the II Additional Family Court at Chennai and re-numbered as O.P.No.5201 of 2023.

5.This narration is to show that the husband and wife have fallen out and are before the Family Court seeking for divorce.

6.It is the case of the plaintiff that the second defendant was not born from the wedlock between himself and first defendant.
