M.S.RAMESH,J.
The appellant herein has been convicted and sentenced to the imprisonment, through the judgment of the learned Sessions Judge, Special Court for Cases under POCSO Act 2012/Mahila Court, Chennai, passed in S.C.No.141/2016 dated 11.03.2019, in the following manner:-
| Conviction | Sentence |
| under Section 302 IPC | Life imprisonment along with a fine of Rs.5,000/- in default to undergo further period of 6 months S.I. |
| under Section 201 r/w. 511 IPC | 3 years S.I. along with a fine of Rs.5,000/- in default to undergo further period of 6 months S.I. |
The sentences of imprisonment were ordered to run concurrently.
2. The aforesaid judgment of the Sessions Court is put under challenge in the present appeal. For the sake of convenience, the parties to the appeal are addressed according to the rank in the trial Court.
3. The case of the prosecution in brief is that the deceased Dhanalakshmi and the accused were live-in partners at No.2/14, 3rd Cross Street, Packiri Garden, Virugambakkam, which house belongs to one Lakshmi. Both the deceased and accused had frequent quarrels, since the accused did not have a regular job and he also suspected the fidelity
