O R D E R
The petitioner herein who holds Patta for 350 sq. metre when tried to put fencing as per the Revenue document, it has been opposed by the Villagers. Hence the present petition has been filed for seeking protection.
2. The villagers protesting the petitioner putting up fence to an extent of 5 cents of land had damaged the fence and there is disturbance to public peace and tranquility in the Village. Hence, the Police has sought for inference of the Executive Magistrate.
3. The learned counsel appearing for the private respondents submits that the land in dispute is a Gramanatham. The petitioner herein is not the resident of the Village based on the Revenue document claiming right upon the land. Hence, the villagers have strong objection.
4. From the documents, this Court finds that Patta and Title documents stand in the name of the petitioner. When there is no contrary document to suspect the title of the petitioner, it is the duty of the State to provide protection.
5. There will be a direction to the effect that if the Surveyor seeks Police protection for measuring the land of the petitioner herein as per the documents, the same is to be provided.
