ORDER
This Writ Petition has been placed on Board pursuant to the order of remand made by the Hon'ble Apex Court in the judgment reported in 2019 (5) SCC 587.
2. Heard Ms.R.Vaigai, learned Senior Counsel for Mr.V.Ajay Khose, learned counsel appearing on behalf of the petitioner and Mr.Abdul Saleem, learned Senior Counsel for Mr.Anand Abdul Vinoth, learned counsel appearing on behalf of the respondents.
3. The learned counsel for the petitioner would submit that the canteen was established in the year 1973, pursuant to the proceedings of the then Chief Engineer and Administrator. The said Authority had accorded sanction for the formation of the Departmental Canteen in Tuticorin Harbour Project. A committee was also nominated by the said Authority consisting of seven persons. She would further contend that the Management of the canteen was directly managed under the Port Trust Management Committee and when the Tuticorin Port Trust was declared as a major Port, it was directly under the control of the Chairman.
