ORDER
This petition has been filed for transfer of investigation in Crime No.1187 of 2021 from the file of the first respondent to the file of the second respondent/CBI to conduct further investigation.
2. The petitioner lodged complaint before the first respondent and the same was registered in Crime No.1187 of 2021 for the offences punishable under Sections 406, 506(1) of IPC and Section 3 of the Tamil Nadu Prohibition of Charging Exorbitant Interest Act, 2003, as against the accused persons. After completion of investigation, the first respondent closed the FIR as “mistake of fact” and filed closure report.
3. Aggrieved by the same, the petitioner filed protest petition in Crl.M.P.No.369 of 2024 and the learned Judicial Magistrate-I, Perambalur, by an order dated 16.08.2024, allowed the petition filed by the petitioner and ordered for further investigation by the very same respondent under Section 173(8) of Cr.P.C., and to file the supplementary charge sheet.
