This Original Petition has been filed to appoint the petitioner as the guardian of the mentally challenged person by name K.Raghupathi @ Raji and permit the petitioner to receive the pension amount of Rs.9,000 + D.A.

2. The petitioner is the brother of mentally challenged person by name K.Raghupathi @ Raji. The said K.Raghupathi @ Raji born on 18.05.1998 and the parents of K.Raghupathi @ Raji are no more. The father of K.Raghupathi @ Raji namely P.Kuppan died on 26.11.2004 and his mother Loganayagi also died on 21.12.2009. The said K.Raghupathi @ Raji had two siblings who are the petitioner and another elder brother by name Thiruvengadam. The said Thiruvengadam also left home 10 years ago subsequent to his mother's death and his whereabouts are not known. Ever since the death of his parents, the petitioner has been taking care of K.Raghupathi @ Raji and he is under his custody. Subsequent to the death of petitioner's father, his mother Loganayagi was receiving family pension. After the death of his mother, K.Raghupathi @ Raji who is incapable and mentally challenged was depended on the petitioner. Though K.Raghupathi @ Raji is entitled to get family pension of his father, the
