COMMON JUDGMENT

The second appeal in S.A No.51 of 2003 has been filed against the Judgment and decree dated 28.02.2012 passed in A.S No.25 of 2011 by the Principal Sub-Ordinate Judge, Krishnagiri, by confirming the Judgment and Decree dated 13.12.2010 passed in O.S No.303 of 2008 by the District Munsif Court, Krishnagiri.

The second appeal in S.A No.52 of 2003 has been filed against the the Judgment and decree dated 28.02.2012 passed in A.S No.26 of 2011 by the Principal Sub-Ordinate Judge, Krishnagiri, by confirming the Judgment and Decree dated 13.12.2010 passed in O.S No.336 of 2007 by the District Munsif Court, Krishnagiri.

The appellants in S.A No.52 of 2013 are the plaintiffs in suit O.S No.336 of 2007 on the file of the District Munsif Court, Krishnagiri, filed against the defendants for the relief of declaration and other consequential reliefs with regard to the suit property, as it belongs to first plaintiff and subsequentially the second defendant in O.S No.336 of 2007 filed a suit for partition against this plaintiffs in O.S No.303 of 2008 before the same Court and both the suits were tried jointly by the Trial Court and it was concluded that the suit in O.S No.336 of
