HIGH COURT OF MADRAS
Hon`ble Mr.Justice R.SUBRAMANIAN
P.Thangavel – Appellant
Versus
The Commissioner – Respondent

Natural justice principles must be adhered to in administrative eviction procedures under the Tamil Nadu Urban Local Bodies Act.

Headnote:

Encroachment - Removal Procedures - Tamil Nadu Urban Local Bodies Act - Sections 128(1), 128(2) - The court emphasized procedural fairness and the necessity of considering objections before eviction, highlighting the obligation of authorities under the Act to adhere to natural justice principles.

Fact of the Case:

The petitioner challenged an eviction notice issued by the Assistant Commissioner under the Tamil Nadu Urban Local Bodies Act, which required the removal of alleged encroachments. Previous orders regarding surveying the property and actions needed were also mentioned in the case.

Finding of the Court:

The court found that the eviction order failed to consider the objections raised by the petitioner in accordance with Section 128 of the Act. The procedure was not followed, indicating a lack of application of mind by the authorities.

Issues: Whether the authorities complied with the requirements of issuing a show cause notice and considering objections prior to enforcing the eviction under Section 128 of the Tamil Nadu Urban Local Bodies Act.

Ratio Decidendi: The court held that principles of natural justice must be observed in eviction proceedings, and that failure to consider the objections raised by the petitioner constituted a violation of statutory and procedural requirements.

Final Decision: The court allowed the Writ Petition and quashed the eviction notice, directing the authorities to reconsider the petitioner's objections.
