COMMON ORDER

These petitions have been filed seeking to set aside the order passed by the learned II Additional Sessions Judge, City Civil Court, Chennai in Crl.M.P.Nos.14943 & 14941 of 2023 in C.A.Nos.21 & 20 of 2019, respectively, by order dated 20.03.2024.

2.The petitioner/accused in C.C.Nos.4805 & 4808 of 2009 was convicted by the trial Court for offence under Section 138 of Negotiable Instruments Act and sentenced to undergo six months simple imprisonment and to pay the cheque amount of Rs.26,13,347/- and Rs.21,88,294/- respectively, as compensation. Aggrieved against the conviction, he preferred an appeal before the Sessions Court in C.A.Nos.21 and 20 of 2019, respectively, which is pending before the III Additional Sessions Judge, City Civil Court, Chennai, in which, the petitioner filed a petition under Section 391 of Cr.P.C. to examine the bank Manager of erstwhile Syndicate Bank, Mettupalayam Branch presently merged with Canara Bank, Annur Road, Mettupalayam, as additional witness.

3.The contention of the learned counsel for petitioner is that the petitioner had given some blank cheques for security purpose in the year 1996 while joining the Chit scheme with the respondent.
