ORDER

This petition has been filed to quash C.C.No.42 of 2021 on the file of the learned District Munsif Cum Judicial Magistrate No.I, Usilampatti, Madurai District.

2. The case of the prosecution is that the marriage between A1 and the 2nd respondent was solemnized on 18.09.1996 and out of the wedlock, they have one male child. While so, the marriage life ran into rough weather and the petitioners, who are the father, mother and brother of A11 started harassing the 2nd respondent. It is alleged that A11 has married A1, while the subsistence of the first marriage and hence, a complaint came to be registered, for quashing which, the petitioners are before this court.

3.The learned counsel for the petitioners would submit that the petitioners are father, mother and brother of A11 respectively and they have nothing to do with the alleged offences and hence, prays for interference.

4. The learned Government Advocate (Crl. Side) would submit that there are materials available to proceed with the case as against the petitioners herein and at the threshold, the criminal proceedings cannot be quashed and the charges against the petitioners have to be gone into only at the time of trial and hen
